• 論文抄録 / 内容記述: 本論考においては，2015 年 9 月に成立した改正個人情報保護法に関し，特に災害時にその迅速な提供が必要となるであろう個人情報の提供の問題につき，災害の多いわが国における，有機的な情報提供の在り方と本人同意擬制の在り方を検討する．また，同様にその情報流通の在り方が問題となる医療情報についても検討を行う．そのために，現状の問題点の把握と今後の方策を示すと同時に，可能な限り外国の災害時における個人情報の取扱いについても紹介し，比較検討を行う．

• 論文抄録(英) / 内容記述: In this paper, the way of providing personal information and the way of taking the consent in a constructive way especially at the time of disaster is considered. Regarding the Revised Personal Information Protection Act, which was enacted in September 2015, the way of providing personal information will be a problem in Japan where we often face disasters. Some sort of constructive way of providing personal information to avoid extra incidents that is related to human lives is needed. At the same time, the way of providing medical information is also discussed in this paper for medical information is very sensitive but needed in time of disaster. This paper tries to show the understandings of current problems and the future plans in providing personal information including sensitive personal information such as medical information in disaster to save peoples' lives. The way of providing personal information in disaster in other countries is also introduced and considered comparatively with Japanese case as much as possible.
