• 論文抄録 / 内容記述: 文部科学大臣の検定を経た教科用図書 (以下、検定済教科書とする) のデジタル化が関連法規定・制度の改正も含めて文部科学省を中心に検討されている。しかし、検定済教科書のデジタル化は、著作物の権利処理の複雑化や大幅なコスト増が予想されるなど課題が山積している。著作物の権利処理の複雑化やコスト増大は、検定済教科書のデジタル化それ自体の停滞を招く懸念があるほか、デジタル化された検定済教科書の品質向上や二次利用等での有効な活用に支障をきたす可能性もある。また、検定済教科書のデジタル化にあたっての制度改正等には複雑な利害関係の調整が必要と考えられ、そうした利害関係が検定済教科書のデジタル化を阻む要因となっている。そこで、本稿では検定済教科書のデジタル化の課題について、まず先行研究や関連法規定・制度、現状のデジタル教科書の実態等を整理した。そして、現行の紙媒体の検定済教科書をほぼそのままの形で発行しつづけることを前提に、それとは独立して検定済教科書のデジタル化を推進するための著作物の権利処理とデジタル (検定済) 教科書の無償化やオープンアクセス化について、関わる利害関係の調整等も考慮しつつ、その可能性を検討した。

• 論文抄録(英) / 内容記述: The digitization of textbooks that have been authorized by the Minister of Education(hereafter referred to as Authorized Textbooks), including revision of related legislation and systems, is currently being reviewed primarily by the given Ministry. However, it is likely that the digitization of Authorized Textbooks will face a host of challenges, including the complexities of copyright clearance of copyrighted works, as well as large-scale projected cost increases. It is feared that the complexities involved with copyright clearance of copyrighted works and cost rises will lead to a delay in the digitization process itself of Authorized Textbooks. And also, it may be this may hinder improvements in the quality of digitized Authorized Textbooks and their effective application for secondary use. Therefore, this paper has organized the issues presented by digitization of Authorized Textbooks, including related legislation, previous research, and current digital textbooks. In addition, this paper has examined ways of copyright clearance of copyrighted works in an age where authorized textbooks have been digitized, keeping in mind the possibility of open access eventually being provided.
